1. Agreement to Terms

By accessing or using the DataMasters Academy website and services, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the service.

These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and DataMasters Academy ("we," "us," or "our"), concerning your access to and use of the DataMasters Academy website and services.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights.

2.1 Course Materials

All course materials, including but not limited to videos, presentations, worksheets, datasets, and code samples, are provided for your personal, non-commercial use only. You may not:

  • Copy, modify, or distribute course materials without written permission
  • Share your account credentials with others
  • Record or rebroadcast live sessions
  • Use materials to create competing courses

3. Payments and Refunds

3.1 Course Fees

All course fees are listed in Hong Kong Dollars (HKD) and are inclusive of applicable taxes unless stated otherwise. Payment must be received in full before course access is granted.

3.2 Refund Policy

  • Cancellation before course start: Full refund minus 10% administrative fee up to 7 days before the course start date.
  • Cancellation within 7 days of start: 50% refund.
  • After course commencement: No refunds are available once the course has started.
  • Special circumstances: Refunds for medical or emergency situations will be considered on a case-by-case basis.
Refund requests typically take 5-10 business days to process after approval.

3.3 Payment Methods

We accept Visa, Mastercard, American Express, PayPal, and bank transfers for local customers. All payment information is processed securely by third-party payment processors.

4. Course Enrollment and Access

4.1 Prerequisites

It is your responsibility to ensure you meet any stated prerequisites for a course before enrolling. We recommend contacting us if you're unsure about your suitability for a particular course.

4.2 Access Period

Course access is granted for the duration specified in the course description (e.g., 6 weeks, 12 weeks). After the access period expires, you may purchase extended access separately.

4.3 Certificate of Completion

Certificates are awarded upon successful completion of all course requirements, including attendance (minimum 80%) and passing any required assessments. Digital certificates are provided free of charge; printed certificates may incur a handling fee.

5. User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information when registering
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Respect other students and instructors in all communications
  • Not engage in any disruptive or disrespectful behavior during sessions
  • Comply with all applicable laws and regulations
Violation of these responsibilities may result in immediate termination of your access without refund.

6. Termination

We may terminate or suspend your account and bar access to the Site immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may simply discontinue using the Site. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

7. Limitation of Liability

In no event shall DataMasters Academy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
